Job Flow Terms of Use

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the websites, forms, and services operated by Harpoon Sales & Marketing LLC (WY), doing business as Job Flow (“Job Flow,” “we,” “us,” or “our”).

By accessing or using https://jobflowcapital.com or any Job Flow landing page, form, or service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must discontinue use of our site and services.

You affirm that:

  • You are at least 18 years old.

  • You are using the services for lawful business purposes.

  • The information you provide is accurate and truthful.

Our services are not intended for minors.


2. Scope of Services

Job Flow operates a marketing and lead distribution platform.

We are not a lender, broker, bank, or financial institution. We do not originate loans, make credit decisions, or provide financial advice.

Our service connects business owners with third-party commercial finance providers (“Partners”), including:

  • Business loan providers

  • Equipment financing companies

  • Working capital providers

  • Startup funding sources

  • Commercial lending institutions

2.1 No Direct Lending

Job Flow does not:

  • Approve or deny funding

  • Issue loan commitments

  • Set rates or terms

  • Guarantee funding outcomes

Any quotes, rates, or offers presented are provided by third-party Partners.

Approval, funding amounts, rates, and terms depend solely on the Partner’s underwriting review.

2.2 Compensation Disclosure

Job Flow’s services are free to users.

We are typically compensated by third-party Partners for marketing services, lead referrals, or customer introductions.

Compensation may influence:

  • The order in which Partners appear

  • Whether certain Partners are displayed

  • The prominence of certain offers

Compensation does not determine your eligibility for funding.

You are responsible for reviewing and evaluating any Partner before entering into an agreement.


3. No Endorsement; Third-Party Services

Job Flow is not an agent or advisor for you or any Partner.

We do not endorse or guarantee:

  • Any lender

  • Any financing product

  • Any funding terms

  • Any approval outcome

Any agreement you enter into with a Partner is solely between you and that Partner.

Job Flow is not responsible for:

  • Partner underwriting decisions

  • Loan servicing

  • Fees charged by Partners

  • Collection practices

  • Disputes between you and a Partner


4. Communications Consent & SMS Terms

By submitting your contact information through a Job Flow form, you expressly consent to receive communications from:

  • JobFlow

  • Third-party commercial finance providers to whom we share your inquiry

These communications may include:

  • Telephone calls (including calls made using an automatic telephone dialing system)

  • Artificial or prerecorded voice messages

  • SMS and MMS text messages

  • Email communications

Consent applies even if your number is registered on any federal, state, or internal Do Not Call list.

Consent is not a condition of obtaining financing or any other service.

All communications are intended to comply with:

  • The Telephone Consumer Protection Act (TCPA)

  • The CAN-SPAM Act

  • Applicable state privacy laws

Each Partner is independently responsible for its communications.

4.1 SMS Program Terms

Description of SMS Use Cases

If you opt in to receive text messages from Job Flow, you may receive recurring automated messages related to:

  • Equipment financing application updates

  • Account notifications and status alerts

  • Funding reminders

  • Customer support communications

  • Promotional and marketing messages

  • Partner-related follow-up regarding your inquiry

Message frequency varies based on your interaction with our services.

Message Frequency

Message frequency may vary. You may receive multiple messages per week depending on your application activity and engagement.

Opt-Out Instructions

You may opt out of receiving text messages at any time by replying:

STOP — to unsubscribe
HELP — for assistance

After you send STOP, you will receive one confirmation message and no further SMS communications from Job Flow unless you re-enroll.

Message and data rates may apply depending on your wireless carrier and plan.

Carrier Liability Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Age Restriction

SMS services are intended for individuals 18 years of age or older.

Mobile Information Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services (such as customer service or messaging platforms) is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Opt-Out Rights

5.1 Opting Out of JobFlow Communications

You may opt out by:

  • Clicking “unsubscribe” in emails

  • Replying “STOP” to text messages

  • Emailing [email protected]

  • Calling +1 (307) 289-5333

Once processed, we will refrain from sending further promotional communications.

5.2 Opting Out of Partner Communications

If you wish to stop communications from a Partner:

  • Contact the Partner directly using their opt-out method

  • Notify Job Flow and we will relay your request

While we require Partners to honor opt-out requests, once information is shared, we cannot guarantee their independent compliance.


6. Permissible Use of the Site

You agree to use Job Flow’s website only for lawful business purposes.

You agree not to:

  • Submit false or misleading information

  • Submit applications on behalf of another person without authorization

  • Introduce malicious code or disrupt site functionality

  • Scrape, mine, or harvest data from our website

  • Use our site for unlawful marketing or telemarketing activities

We reserve the right to restrict or terminate access if misuse is suspected.


7. Intellectual Property

All content on the Job Flow website — including:

  • Logos

  • Text

  • Graphics

  • Layout

  • Software

  • Branding

— is owned by Job Flow or its licensors and protected by intellectual property laws.

You are granted a limited, revocable, non-exclusive license to use the site for personal business purposes only.

11. Limitation of Liability

To the fullest extent permitted by law:

Job Flow and its affiliates shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Lost profits

  • Lost business opportunities

  • Data loss

  • Business interruption

Total liability shall not exceed:

  • $100 USD
    OR

  • The amount paid by you to JobFlow in the past 12 months (if any)

Whichever is greater.

Some jurisdictions may not allow certain limitations.


12. Indemnification

You agree to indemnify and hold harmless Job Flow and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your violation of these Terms

  • Your misuse of the site

  • False information you submit

  • Violation of applicable laws

This obligation survives termination of your use of the site.


13. Changes to These Terms

We may update these Terms from time to time.

Updated Terms will:

  • Be posted on the website

  • Include a new Effective Date

Continued use of the site constitutes acceptance of updated Terms.


14. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Any legal action permitted outside arbitration must be brought in:

  • State or federal courts located in Wyoming

You consent to jurisdiction in those courts.


15. Dispute Resolution & Arbitration

15.1 Binding Arbitration

Any dispute arising out of these Terms shall be resolved through binding arbitration rather than in court, except for small claims court matters.

Arbitration shall:

  • Be conducted by a recognized arbitration provider

  • Occur in Wyoming unless mutually agreed otherwise

  • Be conducted before a single neutral arbitrator

15.2 Class Action Waiver

You agree to resolve disputes individually.

You waive the right to:

  • Participate in class actions

  • Participate in representative proceedings

15.3 Jury Trial Waiver

If arbitration is deemed unenforceable, you waive the right to a jury trial.

15.4 Opt-Out of Arbitration

You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to:

Opting out of arbitration does not invalidate other Terms.


16. Severability

If any provision is found unenforceable, the remaining provisions remain in full force.


17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Job Flow.

They supersede all prior agreements or understandings.
